Copyright & Takedown Policy

Short version: Vireks does not host user-generated content. Your recordings live on your own device. ZADIO EOOD does not receive, store, or display them. If your rights are being infringed by content YOU recorded with Vireks, the takedown notice should go to whoever is hosting that content (a video platform, a social network, a cloud-storage provider, a personal blog), not to ZADIO EOOD. We will, however, act promptly on notices relating to (a) the zadio.bg/vireks website itself, and (b) the Vireks app's own assets (icon, name, screenshots, copy), and we will cooperate in good faith with law enforcement.

This policy sets out how ZADIO EOOD receives and acts on intellectual-property notices — under the EU Copyright Directive (Directive (EU) 2019/790, “DSM”), the EU Digital Services Act (Regulation (EU) 2022/2065, “DSA”), the Bulgarian Copyright Act, and (for U.S. rightsholders who prefer that form) the U.S. Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512).

1. What ZADIO EOOD hosts

  • The Vireks application binary — distributed via Google Play. ZADIO EOOD is the sole copyright holder of the application's source code, object code, icon, branding, and UI. Third-party libraries are used under their own licences; a third-party-notices file ships with the app.
  • The marketing website (zadio.bg/vireks) — static HTML, CSS, copy, and icon images. All copy is authored by ZADIO EOOD.
  • The Google Play store listing — including the short description, long description, screenshots, and promotional images. All such content is authored by ZADIO EOOD.

ZADIO EOOD does NOT host:

  • The recordings users produce with Vireks (these live on the user’s device);
  • User comments, forum posts, social-media content, or any other user-generated content (Vireks has no UGC surface);
  • Third-party advertising or third-party-supplied content of any kind.

This means the realistic takedown surface ZADIO EOOD can act on is small and well-defined: (i) the App's own code/assets, (ii) the website's own copy/assets, (iii) the Play listing's own copy/assets, and (iv) any infringement claim of those by us against a third party.

2. If you believe Vireks itself infringes your rights

If you are a rightsholder (or a duly authorised representative) and you believe that the Vireks application source code, an icon, a name, a UI element, or text in the App infringes your copyright, trademark, design right, patent, trade secret, or other intellectual-property right, send a notice to app@zadio.bg with the elements listed in Section 5.

We will acknowledge receipt within 5 business days and respond substantively within 14 days. If your notice is well-founded, we will at our discretion (i) remove or modify the allegedly infringing element, (ii) negotiate a licence, (iii) take down the affected version of the App from Google Play, or (iv) explain in writing why we believe the use is non-infringing (for example, because of a fair-dealing / fair-use exception, prior art, parallel ownership, or an applicable licence).

3. If content on the zadio.bg/vireks website infringes

Same procedure as §2: send a notice to app@zadio.bg. Because the website is static HTML authored by ZADIO EOOD, a website-side takedown is a simple matter of editing and redeploying the affected page.

4. If content YOU recorded with Vireks needs to come down elsewhere

ZADIO EOOD does not host your recordings and has no ability to remove them from a third-party platform on which you (or someone else) uploaded them. If a video recorded with Vireks is hosted on YouTube, a social network, a messenger’s media library, a cloud-storage service, or a personal website, send the takedown notice to that platform (or its designated DMCA agent). Most platforms list their notice procedure under “Copyright” in their help centre.

Where the affected platform requires (for procedural reasons) a statement from the application vendor confirming that ZADIO EOOD does not store the recording in question, write to app@zadio.bg and we will issue a short factual statement to that effect.

5. Required elements of a notice

Any takedown notice should include the following, in writing, in English or Bulgarian, by email to app@zadio.bg:

  1. Your full legal name, mailing address, and contact email (and, where you are not the rightsholder, the name of the rightsholder and your authority to act on their behalf).
  2. A clear identification of the work you claim is infringed (registration number where applicable; or a URL / sample image / file hash sufficient to identify it).
  3. A clear identification of the allegedly infringing material on our side — the exact filename, URL, screen in the App, line in the source code, etc.
  4. A short factual statement of why you believe the material infringes (e.g. “the icon at vireks_icon_001.png reproduces our registered trade mark BG-12345 in the relevant goods/services class”).
  5. A statement that the information in the notice is accurate to your knowledge, and that you have a good-faith belief that the contested use is not authorised by you, your agent, or the law.
  6. A statement, under penalty of perjury or its equivalent in your jurisdiction, that you are the rightsholder or authorised to act on their behalf.
  7. Your physical or electronic signature.

Notices missing the elements above will still be acted on where the missing element does not affect our ability to evaluate the claim — but a complete notice gets a faster, more reliable response.

6. Counter-notices and good-faith use

If material we removed was in fact used by us lawfully (for example, under a licence, a fair-dealing exception, or by way of nominative trade-mark use), we may restore it after a counter-notice procedure equivalent to the one set out in 17 U.S.C. § 512(g) (DMCA) and Article 17(9) DSM. The substantive equivalent applies under Bulgarian law; the procedural form is the one set out here.

To send a counter-notice (relevant when you are the operator of a third-party platform that received a Vireks-related takedown from us and you believe it was wrongful), email app@zadio.bg with (a) your contact information, (b) identification of the removed material and where it had appeared before removal, (c) a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification, and (d) your consent to the jurisdiction of the Bulgarian courts (or, if you are outside the EU, the courts of your country of residence). We will respond within 10-14 business days.

7. Misuse of the takedown process

Submitting a knowingly false or materially misleading takedown notice may incur liability under Article 21 DSA, Article 17(9) DSM, 17 U.S.C. § 512(f) (DMCA), and ordinary tortious liability under Bulgarian and EU law. ZADIO EOOD reserves the right to seek damages, costs, and legal fees from any sender of a bad-faith notice.

9. Cooperation with authorities

ZADIO EOOD cooperates with EU and Bulgarian law-enforcement authorities operating within their statutory remit. Lawful production requests (subpoenas, court orders, administrative orders) should be sent to office@zadio.bg on the issuing authority’s letterhead. Because we hold essentially no user data (see the Privacy Policy), the realistic response to most such requests is a written statement to that effect; we cannot produce records we do not keep.
